I could be mistaken, but I think we stopped to use that graphic for the installer because we don't have the copyright for it.

Ok, but you dont need a copyright for Free Theme or?

It doesn't matter if you use a work commercially or not. When you publish something which was made by someone else, or which you made yourself but based it on something made by someone else, you must have permission from the original creator.
