No, it can not be used. Graphics from commercial games are copyrighted. By using them in your own game you are committing a copyright violation. Even when you do heavy modification: as long as it is derived from a copyrighted work it is still illegal.

You can be really glad that Ejlol and Len spotted you, because when this graphic would have gotten ingame Nintendo would have the right to sue the hell out of us. Please do not post any more graphics here which are not original work made entirely by yourself. You are bringing the whole project in danger.

There is no reason to give critic as it still can not be used. Please post something useable. (preferly from scratch instead of edits)
