Houston, we have a problem

Post by kr0n05931 »

This is very embarrassing, but a while back, I transfered my files from one of my PCs to another one via an attachment to myself on my gmail account. Now, this may seem very benign, but the gmail TOS, to my knowledge, stated that files transferred over the attachment service on gmail were the property of Google. Which means, that a few of my pixel arts that were not based on prior GPL art may be slurring the legality of The Mana World, and may have to be removed from the source tree.

From what I have gathered, things such as NPCs, clothing, and other things based on prior art from The Mana World that I have made, are still ok to use because of the fact that they are derivatives of a GPL'd work, the player sprite sheet.

Note: This took place sometime in the 2nd semester of 2008.

I am not sure of what this makes of the Trozz, because it is based on AxlTrozz's concept art.

Also, I will delete any attachments I have made that are possibly slurring the legality of the project.

I am deeply and terribly sorry for this inconvenience.
Lazy bum.

Anything posted here before you did the transfer is under GPL too.

While I commend your dedication, how can that possibly be right?
Indemnifying Google that the sender grants (and can grant) a worldwide non-exclusive irrevocable distribution license might be possible; but surely the whole point of email attachments is that the person whose mailbox they're in probably doesn't own them?

What are you reading that's saying ownership transferred?

http://www.google.com/accounts/TOS?hl=en
11.1 You retain copyright and any other rights you already hold in Content which you submit, post or display on or through, the Services. By submitting, posting or displaying the content you give Google a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive licence to reproduce, adapt, modify, translate, publish, publicly perform, publicly display and distribute any Content which you submit, post or display on or through, the Services. This licence is for the sole purpose of enabling Google to display, distribute and promote the Services and may be revoked for certain Services as defined in the Additional Terms of those Services.

(Given that term, I think you'd violate the GPL by posting other folks stuff on Google; but if you posted anything that included GPL work copyrighted by me, feel free to keep using my stuff in a GPL-compatible way).
Again, IANAL,TINLA, this is just speculation.

So according to that TOS your work is still yours and GPL since you posted it here. Google just has the right to fork your art into their own usage if seen necessary.

Unless of course you willfully give the rights to Google just to mess with us.
This message used to be meaningful.

Google has also the right to use your work, not the exclusive right to use your work. You can still use and release it under a different license.
  • former Manasource Programmer
  • former TMW Pixel artist
  • NOT a game master

Please do not send me any inquiries regarding player accounts on TMW.

You might have heard a certain rumor about me. This rumor is completely false. You might also have heard the other rumor about me. This rumor is 100% accurate.
