I lost interest on level 3, but the tiles I've seen aren't from TMW. They are from
Hero of Allacrost.

Actually its from Lost Garden, they are what inspired Lens woodland tileset.

BTW, are our high quality tilesets like the woodland tileset or windmill etc already ingame? Or are they still unused, after 4 years?

Actually there's quite of a bit of stuff still left over from the cr1 project. Ivan's really awesome port town and barn/windmill combo. I's blockwall set with woodland transitions are in client updates...
I'm almost done with that woodland inn tilesets. Wouldn't be to hard to find a reason to make use of what we have.

They are GPL tiles so anybody can use them as far as i know ... so it wouldn't really be "stealing" considering he says here are some free tiles and use them for your game

Im also using some of these tiles for a server ive been working on myself.

GPL doesn't mean public domain. When you make a game with GPL graphics, you must release the whole game under GPL.
I can not, however, see any indications about license conditions on lostgarden.com except for mentioning that they are "free". I think that the artists intention is to put them into the public domain. But that's not our business.

I'm pretty much completely ignorant about most licensing. With this in mind, does TMW not use GPL (or some variant of it) for our graphics? If so, does this mean that any other server that uses TMW's graphics must make everything GPL, including original works added? I'm pretty sure that is not the case, or at least other fork servers have not always done so.
Unless you mean that GPL graphics taken from elsewhere must always be GPL, which makes a lot more sense to me

Lost Garden License
Many of the emails I receive ask questions about licensing my designs and artwork. In order to clear up any issues (and save me some emailing!) I've created this licensing page. When you see reference to the Lost Garden License, it refers to the items listed below.
Basic License
All licensed items use the Creative Commons Attribution 3.0 License. In short, you can use and modify any images and design covered by this license provided that you attribute the original source materials to me. I chose this license because[...]

@ crush, im confused about this quote then...
129 In addition, mere aggregation of another work not based on the Program
130 with the Program (or with a work based on the Program) on a volume of
131 a storage or distribution medium does not bring the other work under
132 the scope of this License.

That's in fact a tricky question.
The GPL was designed for software, not for artwork. For that reason it is hard to tell how certain passages of it have to be interpreted in that context.
In hindsight it was a bad idea use the same license for game software and game content. CC-BY-SA or Free Art License would have been much more appropriate. Personally I would prefer a "May be distributed freely with any software with a FSF-approved free software license" copyleft license.
But now it's too late to change it and we are stuck with it.

My understanding is that GPL graphics can be used in a non-GPL game. The GPL-ness only applies to the graphics, and persists through editing, including aggregation within a single image file. Unless you're writing Piet or something ...

That was my understanding as well, glad this can be cleared up.
