putting the hat on the player-sprite will make it look more into perspective also with my newer version of the top-hat I refuse to draw them any other way and Please do not use that older version of the witch hat.

The older version, which had the same perspective as the player-set, did not use a restricted palette. I edited it - badly - but it at least uses just four shades of grey now:
